What to know about the Alberta Vehicle Seizure Program

The Vehicle Seizure Program is designed to uphold the integrity of road safety regulations and ensure that drivers adhere to the requirements of a valid operator’s License. Through the imposition of vehicle seizure and impoundment, the program seeks to create a strong deterrent against driving with a suspended License, ultimately contributing to safer roadways for all users.

Under Alberta’s IRS Vehicle Seizure Program, your vehicle will be seized for a specific length of time

  • 30 days – A person found operating a vehicle with a suspended or disqualified License will have their vehicle seized for a 30-day period – section 173(1) of the Traffic Safety Act.
  • 60 days – If it is a second occurrence within a 3-year period of the first occurrence, a person found operating a vehicle with a suspended or disqualified License will have their vehicle seized for a 60-day period – section 173(2) of the Traffic Safety Act.

To apply for a hearing following the seizure of your vehicle in Alberta, you can obtain an Application for Hearing form from a local Alberta registry agent. This form is the initial step in requesting a review of the vehicle seizure and its circumstances.

Requesting a hearing allows you to present your case and any relevant evidence to challenge the vehicle seizure. It provides an opportunity to explain your situation, clarify any misunderstandings, and potentially have the seizure reversed or its duration reduced.

Your Application for Hearing form should include accurate personal information, details about the seized vehicle, and a brief explanation of why you believe the seizure was unjust or should be reconsidered. Include any evidence, documents, or statements that support your case.

If your Application for a Hearing is approved, you’ll receive notice of the hearing date and time. Prepare to present your case, evidence, and any witnesses you intend to call to support your position. Be ready to address any questions from the hearing officer and provide a clear account of your perspective.
